GİGİİ'S Membership Agreement
This Agreement has been concluded between Gigiis Textile Design Ind. And Foreign Trade Inc. Co. (“GİGİİ’S”), whose head office is located at the address of Nispetiye Caddesi Övün Sokak Beyazevler2 No:3 Beşiktaş / İstanbul, Foreign Trade Inc. Co. Co. and a member (“Member”) of the website www.gigiis.com (“Site”).

For the establishment of this membership agreement, it is sufficient to enter the requested Member(s) Information and the password you will determine, give the specified approval and/or permissions and press the [Complete Membership] button etc. We kindly ask you to enter your name, e-mail address/mobile phone number and other mandatory information accurately, completely and without errors; If you notice an error, correct it. After the completion of the membership process, you can correct the deficiencies/errors that you notice in the My Account section, which you can access from the Member Login section, or you can contact our Customer Services at 0212 3431676.
After completing the registration process on the Site, the Member can start using the Site by entering his e-mail address and password, provided that he complies with the conditions specified in this Agreement.
In case the Agreement is concluded on behalf of a legal person, the person concluding the Agreement accepts, declares, and undertakes that he is authorized to carry out such a transaction on behalf of the said legal entity, otherwise (in case of the unauthorized transaction) that he is personally responsible for all the resultant transactions he/she has made or will do.
When your membership process is completed, we will send this Membership Information-Agreement (in form-text) to the e-mail address you specified in the Membership Information. It is also included as a form on our Site. A text such as a "special" agreement (in which information is entered as a party) text for the member may not be stored separately in our Company's systems.
You can terminate your membership at any time, by verbal or written notification to our Company through the communication channels mentioned above, without giving any reason and paying any penalty. Likewise, our Company may terminate/suspend memberships for various reasons.
Confidentiality, protection, storage, processing-use and destruction of member-customer information in our Company and on our Site, as well as commercial electronic communications and other matters, the following Privacy Policy, Protection of Personal Data, and Consent Text and Terms of Use are valid.
The Member accepts that he/she will be deemed to have accepted all the terms of the Agreement from the moment he/she starts to benefit from the services and these terms will be binding on him/her.
GİGİİ'S reserves the right to change the following conditions when necessary, in accordance with the legislation or this Agreement, at its own discretion, by providing information on the Site and by obtaining the approval of the Member when the Member first logs into his account through the Site.
Necessary measures for the security of the information and transactions given by the members have been taken in the systems and internet infrastructure by our Company or the relevant institution, depending on the nature of the information and transaction. In your use of our site, all credit card transactions and approvals are carried out online between you, independently of our Company, by the relevant Bank and similar Card Institutions. (Information such as credit card "password" is not seen and recorded by our Company)
Information entered on our site for membership, product/service purchase and information update purposes, as well as sensitive confidential information of credit and debit cards, cannot be viewed by other internet users. In payment transactions made by wire transfer, the member's account information will be kept by GİGİİ'S, with the explicit consent of the member, in accordance with the law.
- Rights and Obligations of the Member
1.1. The Member accepts, declares and undertakes that he will act in accordance with all the conditions in the Agreement and the rules specified in the relevant parts of the Site while using the Site.
1.2. While using the services offered on the site, The member agrees to comply with all kinds of announcements and notifications to be published by "GİGİİ'S" regarding its services with Code of Obligations, Turkish Penal Code, Turkish Commercial Code, Law on Intellectual and Artistic Works, Protection of Trademark and Patent Rights, Protection of Personal Data Law and related Laws, Decree Laws, and other relevant legislation provisions. All legal, penal and financial responsibilities that may arise due to these notifications and unlawful use belong to the Member.
1.3. The Member shall indemnify all kinds of damages incurred by "GİGİİ'S" due to the act contrary to its obligations under this Agreement; GİGİİ'S has the right of recourse to the Member for any compensation, administrative/judicial fines that the Member may have to pay to public institutions and/or third parties due to the Member's behavior contrary to the Agreement.
1.4. The member cannot take actions that prevent or make it difficult for other members and visitors to use the Site; cannot load and lock servers or databases with automatic programs, or attempt to mislead data; otherwise, his membership will be terminated and he will assume all kinds of legal and penal liability that may arise from this situation.
1.5. It is the responsibility of the individuals to back up the correspondence made with GIGII'S and is recommended by GIGII'S. GİGİİ'S cannot be held responsible for the loss or deletion of correspondence due to not taking backups.
1.6 Any record of the membership account terminated by GİGİİ'S or the Member itself may be kept by GİGİİ'S subject to the conditions stipulated by the Law on the Protection of Personal Data; however, GİGİİ'S is free to delete the said records from the moment the membership ends. The member cannot claim any right or compensation regarding the deleted records. However, the Member's right to be informed about his/her personal data is reserved.
1.7. The Member declares and undertakes that the personal and other information provided while registering or shopping on the Site is correct and up-to-date and that if this information is not correct or up-to-date, he/she will fully and promptly indemnify all losses incurred by “GİGİİ'S” for this reason.
1.8. The risks related to the links (links to different websites) on the Site for the purpose of providing information and convenience to the visitors belong to the Member.
1.9. The visual and textual content presented on the Site is for personal use. All rights of all texts, graphics, photos, videos, animations and sounds in the content of the site are reserved; Unless otherwise stated, it cannot be used for commercial or personal purposes without permission and reference. It is forbidden to publish or link any element of the Site in another medium or website without the permission of "GİGİİ'S".
1.10. The Member cannot delete or remove the notes under copyright, trademark, and Law on Intellectual and Artistic Works from any material copied from the Site or printed with a printer.
- Rights and Obligations of “GİGİİ'S”
2.1. In the following cases, “GİGİİ'S” has the right to cancel the said transactions, to stop the use of the Member, to terminate the membership of the Member, to terminate this Agreement unilaterally immediately, in addition to all its rights arising from the law:
(a) ) In the event that information that contains incorrect, irregular, incomplete and misleading information, statements that do not comply with the general moral rules and does not comply with the laws of the Republic of Turkey, is recorded on the Site;
(b) ) In the event that information such as username and password given to the Members by GİGİİ'S or determined by them, their usage rights are shared with third parties, the Member is directly responsible for the malicious use of the password by other persons. Likewise, the Member cannot use someone else's IP address, e-mail address, user name and other information on the internet, and cannot access or use other Members' private information without permission. Any legal and penal liability that may arise due to such use belongs to the member;
(c) In case of using software that will threaten the general security of the Site, preventing the operation of the Site and the software used, performing activities, trying to do it, and obtaining, deleting, or changing information;
(d) In the event that GİGİİ'S detects that the member is misusing the sales system or the Site in the form of harming "GİGİİ'S", providing an unfair advantage, making repeated applications by taking advantage of any deficit (technical etc.) of the GİGİİ'S campaigns, the sales system or the Site;
(e) In the event that the Member acts in violation of all the terms in the Agreement, the rules specified in the relevant parts of the Site and the applicable legislation, while using the Site or shopping.
2.2. During the use of the Site, GİGİİ'S will act in accordance with the conditions specified in this Agreement, the GİGİİ'S Membership Agreement below, the Protection of Personal Data regarding Commercial Communication, and the Privacy Policy on the Site. However, GİGİİ'S is obliged to keep the Member information that it is legally required to keep.
2.3. However, GİGİİ'S will not use this data for commercial purposes for any reason other than its activity. This provision does not prevent the transfer of the contract to third parties.
Within the scope of the above-mentioned purposes, our site uses "cookies", which can be defined as small data files saved on the computers of the Members during their visit. These files are industry-standard files available on all shopping sites, are used to make shopping more efficient and secure for Members.

2.4. In addition, the Member understands that when he uses a credit card to pay the product price for the product purchased through the Site, the credit card number, the expiration date of the credit card, the CVV2 code and similar information should be shared with the relevant financial institutions in order to carry out the transaction.
2.5. GİGİİ'S has the right to use all information related to membership in connection with its own marketing activities, provided that this information is anonymized, even during the contract period or after the expiry of the contract, provided that this Agreement and the applicable legal regulations, including the Law on the Protection of Personal Data, are adhered to.
2.6. GİGİİ'S undertakes that the Member will benefit from the services subject to the Contract, except for technical malfunctions, and that the information shared by the Member will not be shared with third parties, except in cases where it is required to share with third parties in order to achieve the above-mentioned purposes and legal obligations.
- General Provisions
4.1. In certain parts of the Site, different rules and obligations specific to the relevant section may be determined The Member using these sections is deemed to have read and accepted the relevant rules.
4.2. GIGII'S may make unilateral changes to this Agreement in order to ensure the continuity of the services it undertakes. Provided that the ultimate purpose of “GİGİİ’S”, the Site and the services it provides remain basically the same; always has the right to stop the service permanently or temporarily it provides unilaterally, to change the content of the service, including the prices published on the Site, or to cancel it, without giving any reason. GİGİİ'S, if deemed necessary, will publish the updated membership terms on the Site under the same link with the date update, and the Member's approval will be obtained when the Member first logs into his account on the Site. The updated membership terms will be valid from the moment they are published on the Site, and the use of the Site or services will be bound to the new membership terms from that moment on.
4.3. The Member irrevocably accepts, declares, and undertakes that GİGİİ'S may transfer the Agreement to third parties and that it has already authorized the transfer of the Agreement in accordance with Article 205 of the Code of Obligations with this Agreement.
4.4. The validity, interpretation and performance of this Agreement are subject to the laws of the Republic of Turkey and Istanbul Çağlayan Courts and Enforcement Offices are authorized to settle any disputes that may arise from the Agreement.
4.5. The most up-to-date e-mail address that the Member has notified or will notify to “GİGİİ'S” is considered as the legal notification address for any notification to be made regarding this Agreement.
4.6. If the parties do not notify the other party of the changes in their current e-mail addresses within 3 (three) days, the notifications to the old e-mail addresses will be valid and will be deemed to have been made to them.
4.7. Any notification made using the Member's registered e-mail address will be deemed to reach the Member 1 (one) day after the e-mail is sent by GIGII'S.
The Member declares, accepts and undertakes that he/she has read, understood and accepted all of the articles in this Agreement and confirms the accuracy of the information provided.
