ARTICLE 2: Subject
The subject of this Preliminary Information Form ("Form") is related to the sale and delivery of the Products ("Products"), the quality and sale price of which are specified below, in the Law No. 6502 on the Protection of Consumers and in the Official Gazette dated 27 November 2014 and numbered 29188 is to be informed in accordance with the provisions of the Regulation on Distance Contracts published.
ARTICLE 3 : Basic Characteristics and Payment Information of the Goods Subject to Sale
3.1. Information on the description, unit amount, number, and payment terms of the Products are as stated below and/or in the relevant contracts, and this information has also been approved by the Consumer.
3.2. Shipping Fee will be paid by the Consumer.
ARTICLE 4: Validity Period of Commitments
The prices stated in Article 4.1 are the selling price. The announced prices and promises are valid until they are updated and modified. Prices announced for a period of time are valid until the end of the specified period.
ARTICLE 5: Delivery of Products
5.1. The products are delivered to the delivery address specified by the Consumer or to the person/organization at the address indicated, packed with the invoice and intact, within 30 days at the latest from the date of order. If the Seller fails to fulfill this obligation, the Consumer may terminate the contract.
5.2. If the Products are to be delivered to another person indicated by the Consumer, the Seller cannot be held responsible if the person/organization to be delivered does not accept the delivery.
5.3. The Consumer is obliged to check the Products as soon as they are received and immediately notify the Seller of the defects they see.
ARTICLE 6: Right of Withdrawal
6.1 In the distance contracts regarding the sale of goods, the consumer can use the right to withdraw from the contract by rejecting the goods without any legal or criminal responsibility and without giving any reason, within 14 (fourteen) days from the date of delivery of the product to himself or the person/organization at the address indicated. Goods within the scope of Article 7 are exempt from this.
6.2 In order to exercise the right of withdrawal, written notification must be given to the Seller by registered mail, e-mail, or fax within 14 (fourteen) days.
6.3 In order to carry out the return process, the return form we have sent to you must be filled in completely and put in the return package and the return form must be filled in on www.gigiis.com.
6.4 The products to be returned must be delivered with their box, packaging, and standard accessories if any.
6.5 The Seller is obliged to return the total price and the documents that put the Consumer under debt within 14 (fourteen) days at the latest from the receipt of the withdrawal notice to the Consumer.
The seller makes all the repayments specified in the first paragraph at once, in accordance with the payment instrument used by the consumer and without incurring any expense or obligation to the consumer.
(If the consumer uses the installment option to the credit card during the purchase, the refund will be made to the bank at once, and the Bank's payment of the relevant amount to the Consumer in installments is not a violation of this article)
The shipping cost of the Products returned due to the right of withdrawal is borne by the Seller.
ARTICLE 7: Products for which the Right of Withdrawal cannot be exercised
Contracts for the sale of goods that are prepared in accordance with the consumer's wishes or clearly personal needs, which are not suitable for return due to their nature and which are in danger of spoiling quickly or whose expiration date is likely to expire, and products that are not suitable for return in terms of health and hygiene, and provided that the package has been opened by the consumer, the right of withdrawal cannot be exercised in contracts regarding audio or video recordings, software programs and computer consumables
.ARTICLE 8: General Provisions
8.1 In this Form, the consumer declares that he has read and learned the preliminary information about the basic characteristics, sales price and payment method of the product subject to sale and the delivery and gives the necessary confirmation in writing.
8.2 By confirming this Form in writing, the consumer confirms that before the conclusion of the distance contracts, the address to be given to the consumer by the Seller, the basic features of the ordered Products, the price of the Products including taxes, payment and delivery information are correct and complete.
8.3 The Seller cannot be held responsible for the failure of the ordered Product to be delivered to the Consumer due to any problems encountered by the courier company during the delivery of the Products to the Consumer.
8.4 The Seller is responsible for delivering the Products intact, complete, in accordance with the qualifications specified in the order, and with warranty documents and user manuals, if any.
8.5 The Seller may supply a different Product of equal quality and price, upon understanding that the Products cannot be supplied for a justifiable reason before the delivery time, by informing the Consumer and by obtaining his written approval.
8.6 If the delivery of the Products becomes impossible, the Seller informs the Consumer before the contractual performance obligation expires and returns the total price to the Consumer within 10 (ten) days.
8.7 If for any reason the price of the Product is not paid or cancelled in the bank records, the Seller is deemed to be relieved of its obligation to deliver the Product.
8.8IIn the event that the price of the Products is not paid to the Seller for any reason, the Consumer returns the Products to the Seller at his own expense, within 3 days at the latest following the notification of the Seller. All other contractual-legal rights of the Seller, including the follow-up of the Product price receivable, are reserved separately and in any case.
ARTICLE 9: Competent Court
The seller can make his applications regarding complaints and objections to the arbitral tribunal or the consumer court for consumer problems in the place where he/she purchases the goods or services or where he/she resides within the monetary limits determined by the TR Ministry of Commerce in December every year.
ARTICLE 10: Other Provisions
After this Preliminary Information Form is read and accepted by the Consumer in electronic environment, the stage of establishing a Long Distance Sales Agreement will be started.
